One US agency (wishes to remain anonymous) submitted their cases to the court Tuesday July 7th, and was told that all their cases were accepted and to expect new court dates in the near future. This agency thought it could even be possible that they would begin to hear cases by the end of this week.
*Note: Obviously this is not one of the 2 agencies that reported the MOWA closing.

ReplyDeleteMy theory is that there is a new process, and that either they are not closing as rumored or their work is done and they need a break. Regardless. I have faith that they are not hanging us out to dry.

ReplyDeletePerhaps a distinction needs to be made so that we are all saying the same thing and can understand one another better.
ReplyDelete1. There is the ban.
2. Because of the ban an investigation incurred. The investigation has several parts to it, i.e. information gathering, writing of reports, reading of reports by MOWA and the courts, approval of reports by MOWA and the courts, etc.
3.Assignment of new court dates, which can occur in any number of ways.
4.Passing court.
My understanding is that we are in the middle of stage 2 - past information gathering and somewhere in the report process. It seems like they are not going to give some countries, agencies, orphanages (other than the three originally approved in May) special privileges or court dates ahead of anyone else. So....
This is my breakdown and understanding. Does anyone have a different impression?
As far as I am informed I would say we are now at the beginning of step 3, but for me the MOWA approval (you mean the letter needed for court?) belongs to step 3.

Our US agency tells us a lot of times, things are acutally done, agency by agency, or now orphange by orphange. I know that with the orphange Enat Alem where our baby is from, there will be certain days court dates are given, so the orphange rep doesnt have to appear every day. They will group them.
ReplyDeleteOh, also. I do somewhat thing that certain agencies get different privledges...which I dont agree with. I have a feeling its who you know and the relationship the agencies have with orphanges and the government. Just my two cents.
ReplyDeleteWhere did the breakdown of the process come from? I have not seen this before? Stage 2? No. I think they have restructured and we cannot base our current postion on outdated procedure. I have heard from my agency that the investigation is OVER and the ban is LIFTED. We are currently waiting to see what they say about the new procedure as the begin to implement it.....TODAY.
ReplyDeleteAnon 7:02 I was only referring to the ban and the process to resolve it. The letter approving paperwork is separate from that. That would go along with passing court in my breakdown. Also when you say that something is going on today, what are you referring to? Have you gotten word on something?
ReplyDeleteAnon 7:03 my agency also talks about the groupings but I do not think that the courts are considering our cases yet within the groups that are getting dates.
Anon 7:04 I actually do not think that there is any favoritism there. That has been the one consistent comment that my husband and I have heard throughout this entire adoption process, and since this ban we have done extensive research and have reached out to many individuals with international influence. Repeatedly we have been told to do nothing and wait this out. In fact, using influence is greatly frowned upon and backfires. I beleive that the only advantage of a close relationship or knowing someone is the amount of information and the kind of updates that are given out but not court dates.
Anon 6:44 I think you are right. According to my agency we are somewhere in the last phases of step 2, but apparently other agencies think that we are in the beginning of step 3. I personally believe that the reason that some agencies are saying that the investigation is over, and some are saying it isn't, may be that the first ones are talking about the police investigation and the second ones are talking about the entire step 2 that you describe.
ReplyDeleteTo anon 7:02 no I don't think the other person is talking about the letter for court, I think she's talking about approval of reports from the investigation, which is part of step 2.
Anon 7:14 What new procedure? Where did that come from? That is speculation. As I specifically stated in my post, the breakdown is MY perception that I am using and was explaining to all in order to try and put all on the same page because I think that the different words, ie investigation have different meanings to different people. In no way am I trying to imply that I am an authority or have an inside track.

Perhaps the are unveiling a new procedure, perhaps they are giving court dates. So IO dont really know where you got all of the 'steps' you laid out for us. We (she) are not talking about old or new procedures in relation to the adoption process, we are talking about how it seems that this hole ban-investigation-thing is going on.
